UNHCR Position on the Situation of Asylum in Ukraine in the Context of Return of Asylum Seekers

UNHCR issued a position paper on the situation of asylum in Ukraine in the context of return of asylum seekers. The paper provides information on and an analysis of the protection situation of asylum seekers and refugees in Ukraine. The paper does not take any position on individual cases. With respect to the return of third country asylum-seekers to Ukraine, UNHCR advises States, contemplating such returns, to refrain from doing so, as at present no assurances can be given that the persons in question: a) would be readmitted, b) would have access to a fair and efficient refugee status determination procedure, c) would be treated in accordance with international refugee standards or d) that there would be effective protection against refoulement.
